The magistrate pointed out Alves’ peculiar conduct of not conversing with or making eye contact with the young woman after they left the restroom, which contradicts his claim of a benign interaction.

The judge also highlighted that Alves’ actions prior to entering the restroom at the nightclub are inconsequential. The court order stated that normal behavior, such as engaging in conversation or enjoying a beverage, does not negate the alleged incident within the restroom, where there’s no available footage. The victim maintains her claim of being sexually assaulted by Alves.
